The State has told the Lusaka High Court that businessman Harry Valden Findlay is not entitled to bail, arguing that the terrorism-related offence he faces is non-bailable under the Anti-Terrorism and Non-Proliferation Act.
The State has consequently asked the court to dismiss Findlay’s application for temporary freedom and allow him to remain in custody pending further proceedings.
Findlay is challenging his continued detention through a habeas corpus application before the High Court.
The application was made through his family, with his nephew, Pierre Findlay, swearing an affidavit in support of the proceedings.
However, the State, through Detective Inspector Eric Ihindachinapu of the Zambia Police Service Anti-Fraud and Cyber Security Unit, has opposed the application.

According to the State, Findlay was picked up for questioning on August 4, 2026, at Langani Safari in Chisamba on suspicion that he was involved in acts of terrorism.
He was initially taken to Ibex Hill Police Station for safe custody before being transferred to Westwood Police Station on August 9, where he was warned and cautioned and subsequently charged together with three other suspects.
The State said Findlay was later transferred to Mwembeshi Central Correctional Facility.
It argued that the offence of prohibition of terrorism and non-proliferation is non-bailable under the Anti-Terrorism and Non-Proliferation Act.
The State told the court that a docket has been opened and forwarded to the National Prosecution Authority (NPA) to facilitate Findlay’s appearance before court and determination of the matter.
It maintains that all necessary procedures were followed in Findlay’s apprehension and arrest.
