The Law Association of Zambia (LAZ) has expressed deep concern over reports of individuals remaining in police or state custody for extended periods without being brought before a court.
In a statement issued on September 22, 2026, LAZ stressed that personal liberty is a fundamental constitutional right protected under Article 13 of the Constitution of Zambia, which mandates that any arrested person not released must be brought before a court without undue delay.
The association noted that these safeguards are reinforced by sections 30 and 33 of the Criminal Procedure Code Act, requiring prompt action, release on police bond where applicable, or a timely court appearance.
LAZ emphasized that detention must never be used as a substitute for proper investigation or as a preliminary method to determine whether an offense has been committed, citing the Supreme Court precedent in Munyonsi & Another v Ngalabeka.

While acknowledging the duty of law enforcement agencies to investigate crime and bring offenders to justice, LAZ underscored that effective enforcement and the protection of constitutional rights must go hand in hand.
The association has urged the Zambia Police Service and other investigative authorities to review all ongoing custody cases, ensure every detention has a lawful basis, grant police bonds where permitted, and uphold the constitutional safeguards applicable to every detained person.
