Tanzanian opposition leader to face trial on treason charges

DAR ES SALAAM, Tanzania — Tanzania’s High Court has ruled that opposition leader Tundu Lissu has a case to answer in his treason trial, moving the proceedings to the defence stage.

A three-judge bench ruled Friday that prosecutors had established a prima facie case after presenting evidence from 17 witnesses. The court said the evidence was sufficient to require Lissu to defend himself, without determining its credibility or whether it would ultimately support a conviction.

The court considered key elements of the treason charge, including Lissu’s allegiance to Tanzania. Justice Dunstan Ndunguru said Lissu’s Tanzanian citizenship and allegiance were not disputed.

Lissu faces charges under Section 39(2)(d) of Tanzania’s Penal Code over statements he allegedly made at a CHADEMA meeting in Dar es Salaam on April 3, 2025. Prosecutors accuse him of encouraging public action to prevent the 2025 general election unless the government implemented electoral and political reforms.

If convicted, Lissu could face the death penalty.

Lissu has denied the allegations and has been detained since April 2025. His defence team plans to present witnesses, including senior government, security and defence officials, as well as CHADEMA leaders.

The court’s ruling does not determine Lissu’s guilt or innocence. The case will now proceed with his defence before a final judgment is issued.
